On July 24th Annual Election Meeting Results were announced as followed:

Organization Meeting
The new Board immediately attended after the end of the Open Meeting its Organization meeting to form a new Board by the election of Officers. In violation to Davis-Sterling, members were not allowed to observer this meeting.
Revoke Member Election
Before the formation of the Board by selecting Officers, Helen Revalus moved to revote the election of Michael Barto. Michael Barto protested that this was not on the agenda, should be schedule for future meeting, that he had a right for a hearing with witnesses and that this was not the function of an Organization meeting.
Must Be Removed Now.
Helen Revalus countered that it was too important that Michael not serve anytime on the Board and requested that he be removed immediately. Helen Revalus, Mary Williams and Candice Shultz voted to revoke Michael Barto's election. Terri-Piper Johnson abstained.
Does Not Physicall Sleep in His Condoi
Helen Revalus reason was that even though Michael Barto has declared that his condo was his primary residence, he had violated the Election Rules adopted in 2014 by htree Board member. The Election Rules overwrote the HOA By-Laws by restricting Board members to only those persons whose primary residence is Harbor Vista. Helen Revalus said that since he does not physically sleep at his condo on a regular bases, that he was in violation of the Election Rules. Michael was asked to leave the meeting by the three members.

At the closed of Organization Meeting, Helen Revalus was elected as President, Terri Piper Johnson continues as Secretary, Mary Williams continues as Board Treasurer, and Candice Shultz became the new Member at Large.■

HVN 2017 ENDORSEMENTS

Once a Year, the HOA holds elections called the Annual Meeting. Each member of the HOA (property owner per unit) has 5 votes to elect five candidates. This is a total 900 votes across 180 units. If a member owns multiple units, they can cast multiples of five vote each. These votes are cumulative which means that each members can cast all their votes for one candidate or distribute them across multiple candidates.
Six Candidates
The 2017 election, represents the first time since 2013 that we have a contested election with more than five candidates for five positions. This year we have six candidates. Terri-Piper Johnson and Mary Williams are running as incumbents. Michael Barto and Cynthia Lee are former Harbor Vista Board members. The remaining candidates Helen Ruvelas and Candice Shultz will be new to the Harbour Vista Board - though candidate Helen Ruvelas has served as a board officer (including President) on various organization and Candice Shultz was a Co-President at another HOA. WE ENDORSE TWO CANDIDATES
Harbour Vista News has decided to “Endorse” two of the Candidates. Michael Barto (yours truly [and self serving]) and Terri-Piper Johnson These are the only two candidates that have stated in their nomination requests that negotiation of the Land Lease must be a major priority.
For Myself
Most of you that read the Newsletter and know what I stand for. I want members to work together. I am very concerned with our property values remaining stagnant. Too many Harbour Vista properties are purchased as rentals because of large return on investment with low cost. This can only be stopped if Harbour Vista property values increase. The Land Lease must be extended and Harbour Vista financials must improve. Read my campaign statement.
For Terr Piper-Johnson
Terri-Piper Johnson has the same Land Lease Priorities as I do. But she also wants HOA fiscally responsible. When Terri was elected as Board Secretary to the current Board, she campaigned to curtail HOA legal expenses. Her action resulted in our legal council fees being collected on a contingency basis for a completion of a litigation. Read her campaign statement.
Set Mandates
Though your vote cannot elect the HOA President, the amount of votes cast may influence how the Board’s mandate is defined and who they select for which officer.
Election Requirements
As long as I have been tracking the Harbour Vista election, Quorum is never been met at the Initial Annual Meeting (92 members cast votes). This requires that the meeting be re-convened from anywhere from one week to 30 days later. At that time, quorum requirements are reduced to just 46 members cast votes. If that is not met, a similar procedure is repeated reducing the quorum again till the election can be certified and the results announced. 
Missing Ballot?
If you threw away your ballot, you can request another one from Majority Rule or better yet come to the Annual Meeting on June 26th, ask for a ballot and cast your vote.

Quorum of 91 vote cast was not met at the June 26th meeting (only 73 votes cast). Quorun will be reduced to 46 votes cast and the Annual (Elections) will be held on July 24th. Members may still not cast their ballots, if they have not already done so up and to the meeting on July 24th.■

Due to a recently mailing by non identifying sender disucssing the current election, many members are furious that their mailing address has been compromised without their permission. But according to the Davis-Stirling Act Civic Code §5200(a)(9), any member can obtain this list which consiting of only a member's name, property address, and mailing address. I held the position as Secretary for Harbour Vista HOA from 2012 to 2013. I am the current Spokesperson for the HOA Architectural Committee.
State why you should be elected to the Board of Directors:
Our HOA has been running in the red since September 2016. We cannot continue this way. There is no extension to the Land Lease. Out legal expenses are out of control. Property values are static. With low property values and high rents, Harbour Vista has become a prime investment property to convert units to rentals. Recently an investor purchased three 3 bedrooms for rental units in less than four months. The only way to stop this is to increase the property values by making Harbour Vista financially solvent. These goals need to be accomplished without significant impact to its members. For the Land Lease extension, we must start negotiating with Dermot Realty immediately. Some creative financing must be made available to fixed income members. To return to solvency without significant increase in dues, I propose that the HOA turn over maintenance responsibility of "Exclusive Use Common Areas (EUCA)" to its members such as the balconies. This turnover will require a working Board to negotiate with the members as to remaining shared expenses. For many years the parking and roadways remain shabby. I propose a two year monthly assessment to funds these repairs which can be use as collateral to fund this project.

Too many members this that Management company is doing very little and cannot be trusted. I think they must be probably managed by the Board. I propose implementing a process such as a weekly conference call with the Property Management Company and open this to members for status updates to get these things on track.

As a HOA Board member, I consider that I should facilitate, not dictate. The Board must be transparent to members, public in their processes and use a team of volunteers to implement HOA policies. This is hard work for the BOD. I already have a track records for success when I services on the Board in 2012 - 2013. Please consider voting for me.   1. How do I vote?
    Refer to the instructions on the Ballot and items I through 5 above.
  2. Do I sign the Ballot?
    NO. There is a space on the green envelope that does require your signature to comply with Civil Code §5115(a)(l).
  3. Do I sign the Address Envelope?
    YES. The green envelope MUST also contain your name and return address.
  4. Can I use a return address label?
    YES. But, you will still be required to sign your name in the upper left hand comer of the green envelope.
  5. When must I return my voted Ballot?
    Please see the Voting Instructions on the reverse which show the date by which the Ballots must be returned if you plan on voting by absentee Ballot. If you plan on attending the meeting, you may cast your Ballot at that time.
  6. If I lose my Ballot that was sent to me, can I get another one?
    YES. Contact Action Property Management, Inc. at (949) 450-0202. You will be required to
    sign a statement under penalty of perjury that you either lost, destroyed or did not receive the first Ballot. The Inspectors of Election shall maintain a record of each such request and if it is determined that the Owner voted twice, even by mistake, the first Ballot received will be counted.
  7. Can I change my vote after my Ballot has been returned?
    NO. The Ballot is irrevocable. If it is determined that an Owner voted twice, even by mistake, the first Ballot received will be counted.
  8. How are Ballots Counted?
    Ballots are counted and tabulated by the Inspectors of Election in public at the Annual Meeting
    following the close of balloting. Any Member of the Association may witness the counting and
    tabulation of thc votes.
  9. What if I want to vote for a candidate that is NOT on the Ballot?
    A member can do a write-in vote for someone not on the ballot, the person must be nominated and accept the nomination prior to or at the meeting in order to be elected. More Election Information and Correction
BALLOTS ALREADY MAILED IN CANNOT BE REPLACED
If you mailed your ballot into Majority Rules prior to learning of the known "Write-In" candidates running for a seat on the Board, unfortunately you will not be able to void that ballot and request a replacement ballot.

According to Davis-Sterling Civil Code §5120 and our Election Rules ballots are "Irrevocable" once they are received by the Election Commission (Majority Rule). So, unfortunately those of you who mailed your ballot in and now would like to vote for some of the known write-in candidates you will not be able to do so. However, your valid ballot will count toward reaching Quorum at the Annual Meeting.

According to Davis-Sterling Civil Code §5120. Counting Ballots; Irrevocable, once the ballot is received by the Election Commission (in this case "Majority Rules"). .■

NOTICE OF ANNUAL MEETING OF THE MEMBERSHIP

MEETING DATE: JUNE 26, 2017

THE PURPOSE OF THE MEETING IS AS FOLLOWS:

  1. To elect new Directors: Five (5) Directors will be elected for a term of one (1) year;
  2. To determine the allocation of any excess operating funds at the end of the current fiscal year;

If quorum is achieved and Directors are elected, there will be an Organizational Meeting of the Board of Directors immediately following the Annual Meeting to appoint officers.

HOW DO I VOTE?

The voting is accomplished by secret ballot, as mandated by California Civil Code. If you cannot attend, you may vote by completing and returning the enclosed Secret Ballot. If you do not wish to cast a vote, please check the "Quorum Purposes Only" box as this will help establish quorum for the meeting and save the Association added costs if quorum is not met.

ll1c Ballot may be sent or hand delivered to the Inspcctor(s) of Election, c/o Majority Rules, LLC, PO Box 608, Yorba Linda, CA 92885. All ballots must be received by Friday, June 23, 2017, othen:vise ballots may be hand delivered to the meeting, or any adjournment thereof, prior to the close of balloting.

HOW MANY VOTES DOES EACH HOMEOWNER HAVE?

Each unit has a total oftive (5) votes to cast. A member of the Association has armounced his/her intention to vote cumulatively; this means, you may cast all of your five (5) votes for one candidate, or you may distribute your five (5) votes among the candidates in any way, provided you do not vote with fractions and the total number of votes does not exceed five (5). Members and Candidates may witness the review, counting, and tabulation of the secret ballots by the Inspector(s) of Election once the balloting has been closed.

CANDIDATES

The known candidates are: Michael Barto, Terri Piper-Johnson, Gayle Poynter, Candice Shultz and Mary Williams. At the Annual Meeting, additional nominations will be taken from the floor for candidates to serve on the Board. Each nominee will be given a chance to present a brief speech on his/her qualifications for consideration.

IT IS IMPORTANT that you either attend the Annual Meeting or return your Ballot since a quorum (51% of the voting power of the members - 92 members) must be present either in person or represented by secret ballot to conduct the annual meeting. (Bylaws, Article II, Section 2.03)

Election of the Board of Directors
  1. The Membership is electing five (5) Directors for a term of one ( l) year. If you cast more than five (5) votes, your ballot will not be valid and your votes will not be counted. Please vote by placing the number of votes (1, 2, 3 ... ) by the candidate's name. Do not use an "X" or checkmark to cast your votes. The actual Ballot is enclosed with this information and marked "Irrevocable Secret Ballot." For the purpose of electing the Board of Directors, you have five (5) votes which all may be cast for one candidate, or cast among several candidates as desired. Fractional voting is not allowed and the total number of votes cast may not exceed five (5). Ballots marked otherwise may be deemed invalid.
  2. After you have finished voting, place your completed Ballot into the white envelope which states, "Irrevocable Secret Ballot Enclosed."
  3. Place the white envelope (containing the completed Ballot) into the green "Address Envelope." Seal the green envelope and print your name and property address in the upper left hand comer of the front of the envelope, then sign the green envelope in the space provided.
  4. Place your Green Address Envelope into the United States mail, private overnight mail service; OR deliver your envelope to the Inspectors of Election, c/o Majority Rules, LLC, PO Box 608, Yorba Linda, CA 92885. The last date absentee Ballots can be accepted (either by U.S. Mail, overnight delivery service or hand delivery) is 5:00P.M. on Friday, June 23, 2017.
  5. All votes received prior to the close of balloting will be counted and tabulated by the Inspectors of Election in public at the annual meeting on June 26, 2017 after the close of balloting.
