NEW LANDSCAPE COMPANY
Artistic Maintenance arrived promptly around 8AM on Thursday October 1. They brought a crew of five and will will be on site for three consecutive days through
Saturday. Their plan is to get the landscaping under control and then set up a schedule for twice a week.
Entirely Over Grown
Harbour Vista landscaping has become completely over grown in less than a month. Artistic Maintenance
is in the process of hauling away Large bags of grass and plant material. Walkways are being cleared.
Background
Our Association lost its landscape company with no notice at the beginning of September. The company went out of business. Normally landscape maintenance is performed twice a week at the complex. But since the beginning of September, all landscaping has stop and the grass has over grown. At the HOA Board Meeting held last Monday September 28th the award was given to Artistic Maintenance.

News Flash
TIERRA VERDE OUT OF BUSINESS
Tierra Verde, the landscape company for Harbour Vista, abruptly informed Action Property that they would no longer service Harbour Vista as of September 1st. They have gone out of business. The company assets were sold to another company and their employees let go.
Out for Bids
The Board has asked Peggy Shaw to expedite getting proposals from three (3) landscape companies. It may take a few weeks to get the proposals and for the Board to select and hire a new landscape company.
Waiting
So, until a new landscape company is hired, the lawns will not be mowed, sidewalks won't be cleaned and shrubs will not be trimmed. It's a temporary problem the Board will work to solve as soon as possible. ■

IN MEMORY
Recently two of our Harbour Vista neighbors passed away. We extend our condolences to their families and friends.

Wilma (Toni) Lund
lived in the Cabana building and was often seen riding her electric chair in the complex with her dog Beauty. She would often stop and talk with neighbors she saw on her way. She was very outgoing, friendly and independent and enjoyed visiting with neighbors.

Moisey Fridman
(Mike) lived on Blackbeard with his wife Rosa. He was known by his neighbors as a friendly man who took an interest in the Harbour Vista community and HOA. He looked forward to receiving the Harbour Vista Newsletter and on occasion sent letters to the Editor.

Both of these neighbors will be missed.■

Photo Opt
The above photo is of a boat parked behind a garage in the Cabana parking area. It is also parked next to a red painted curb (fire lane). The boat has been parked there for 3 days (maybe longer). This is clearly a violation of the HOA Parking Rules. See Notice (this link).
Update (03/11/15): The Boat was "Green" ticketed by the HOA and has since been removed.

Current Updates Time Line
  • (July 21): The Court has set the Trial date of February 22, 2016 for the HOA vs. Homeowner.
  • (July 17):The HOA posted the $10,000 Bond to enforce the Courts Ruling.
  • (July 2) Court Issues Ruling (see below Article).
"HEARTBROKEN HOMEOWNER" CASE UPDATE
On July 2, 2015 the Judge in the case involving the HOA and the homeowner, issued his ruling.
Preliminary Injunction Granted
The judge granted a preliminary injunction that enjoined the homeowners from conducting any further construction, modification, remodeling or other work on their condominium unit without prior written consent from the HOA Architectural Committee or the Board of Directors.
HOA Must Post $10,000 Bond
The issuance of the injunction is dependent upon, and will not become effective until such time as Plaintiff (Harbour Vista HOA) posts a $10,000 undertaking (bond) in favor of Defendants (Homeowner) per CCP 529.
Failure of Legal Counsel?
The attorney representing the homeowner did not present his brief and the materials supporting the homeowner's position in a timely or complete manner. The homeowner no longer has this attorney representing them.
Next Step Trial?
The next court date is scheduled for July 21, 2015 for a "case management" meeting with the judge. To date the current HOA Board has not agreed to meet again with the homeowners. It appears the HOA Board and the HOA attorney intends to take this case to a trial.

VACANT SEAT ON THE HOA BOARD
There has been a vacant seat on the Board for 6-7 months now. Our HOA Board should consist of five (5) members however there has only been four (4) members for the past 6 months. When the fifth member moved from Harbour Vista the remaining four (4) members chose not to appoint someone to the vacant seat.

With the upcoming election for new Board of Directors we should see five people elected to serve on the Board once again.

Perhaps you are considering running for a seat on the Board. You may want to see the Board be more transparent and responsive to the homeowners/residents. Perhaps you have concerns about how long it takes to get things done in the complex. By serving on the Board you would be in a position to influence these issues. ■

SLOW DOWN !!!!!!!!!!!
Harbour Vista Residents are expressing concern about cars driving too fast on Lago and Blackbeard. The speed limit (per our Rules and Regulations) is 10 MPH inside the complex.

The concern is that cars speeding might injure a child, adult or pet that is in the parking areas. Extreme caution should be used when driving through the parking lots where children might be exiting a car and may be in the driving area.

Residents need to be cautious and observe the 10 MPH SPEED LIMIT INSIDE HARBOUR VISTA. We don't want to see a child or adult injured because someone was speeding through the parking lots. LET'S ALL SLOW DOWN!

Community Garage Sale 2015
Garage Sale Worth The Effort
Harbour Vista's Community Garage Sale was held on July 18th. Well over 100 persons visited the event, participation by residents was modest compared to last year. Weather impacted with slight sprinkles and a gloomy overcast. Low participation of sellers was attributed to a very short notice with the first announcement

at the last Board Meeting on June 29th. One participant stated she had just heard about the Garage Sale a week before. A resident said they really needed more time to prepare, like a two months notice. But those that participated say business was worth the effort and it is nice to socialize with their neighbors.

NO Electricity Thursday
On this Thursday March 19, Harbour Vista for the Lago, Blackbeard and Cabana buildings will have the electricity turned off. The outage is scheduled from 8AM to 3:30 pm. Edison sent out notices last weeks about this planned outage. If you use electricity to to prepare your breakfast, cook early. Please note, no one in the Grunion buildings of the Harbour Vista are affected. ■

Update: Edison did no fully explain in the letters they sent out to the residence that this power outages would also affect parking and the garage access from Cabana Drive. Late on Wednesday March 18, residence were surprises to see parking and access notices along the Cabana driveway.
