PETITION FOR DISMISSAL OF BERDING & WEIL LLP AS LEGAL COUNCIL FOR HARBOUR VISTA HOMEOWNERS’ ASSOCIATION.
The undersigned members of the Harbour Vista Homeowners’ Association hereby petition the Board of Directors to dismiss Berding & Weil LLP as our legal council. Berding & Weil LLP have demonstrated that they do no work for the benefit of the HOA but only to enrich themselves.
- Berding & Weil LLP promoted litigation action against a property owner, instead of a negotation.
- This resulting a $94,695.00 legal expense lost to the HOA.
- For over six months, Berding & Weil LLP represented that the member under HOA legal action did not have City approval for their remodeling project until a Judge ruled that this was false.
- Berding & Weil LLP promoted unnecessary legal expenses for a General Contractor and Structural Engineer to refute the City’s approval.
- Berding & Weil LLP inflated Harbour Vista property values to misrepresent funds available for liquidations for a court hearing.
- There is an inherit conflict of interest between Harbour Vista HOA and Action Property Management because Berding & Weil LLP are legal council for both.
